Everi announces victory in patent lawsuit over its CashClub Wallet product

Everi Payments, the wholly owned subsidiary and FinTech business of gaming content and solutions provider Everi Holdings, has announced the company's victory in the US courts following a patent lawsuit against Sightline Payments, dating back to 2021. 

Las Vegas-based Everi said it has won five inter-partes review proceedings held before the US Patent and Trademark Office’s (USPTO) Patent Trial and Appeals Board. The lawsuit involved Sightline accusing Everi of commercializing a product, the CashClub Wallet, that allegedly infringed on at least five of Sightlines patents "that allow for cashless transactions used in casino gaming offerings and non-gaming spend."

The original motion was filed by Sightline on September 30th, 2021, when the company filed a patent infringement suit in the Western District of Texas US District Court. However, the case was dismissed in June 2022. Everi later filed for a review of the patent infringement claims, challenging Sightline’s allegations against the company. 

The Patent Trial and Appeals Board (PTAB) issued a series of rulings that commenced on August 30 this year, holding that the claims made by Sightline against Everi were not patentable.

Everi in a press statement noted: “A patent claim is unpatentable under federal law if the differences between the claimed subject matter and the prior art are such that the subject matter, as a whole, would have been obvious at the time the invention was made to a person of ordinary skill in the art to which said subject matter pertains.” 

Everi’s CashClub Wallet is a cashless gaming solution that enables gamblers and operators to reduce the need for cash inside gaming venues. Over 20 gaming venues have adopted the platform across at least six states.

Everi Chief Legal Officer Kate Lowenhar-Fisher said: “Everi is gratified that after reviewing all of the facts and testimony, the PTAB found in our favor. As with all litigation, there is uncertainty and additional appeals may be forthcoming.”

Sightline also provides payment products for gaming operators in the iGaming, land-based casino, and sports wagering industries, with its clients including BetMGM, Boyd Gaming, Caesars Sportsbook, and casinos operated by the Choctaw Nation.
