New South Wales proposes facial recognition, third-party exclusion scheme to combat gambling harm

New South Wales (NSW) liquor and gaming regulators are seeking public feedback on proposed measures to curb gambling harm, including the introduction of facial recognition technology and a third-party exclusion scheme at gambling venues. 

The proposals, which will be open for consultation from February 17 to March 14, aim to help identify and exclude problematic gamblers from participating in gaming activities.

The NSW government said it is ensuring strict privacy protections for the use of facial recognition, with regulations in place to prevent venues from using the technology for marketing or general surveillance purposes. 

Under the proposed scheme, family members and friends of problem gamblers will be able to apply to ban individuals from participating in gambling activities for a minimum period of 12 months, with the possibility of extending the exclusion for up to three years. A temporary 21-day ban can also be imposed while an application is under review.

David Harris, Minister for Gaming and Racing, said: “Third-party exclusions are designed to help those experiencing gambling harm and their loved ones when other avenues to seek help may have failed.”

The government sees the facial recognition system as an essential tool in identifying excluded patrons, particularly in crowded environments like venues, clubs, and hotels. Harris described the technology as an “important harm-minimisation tool.”

The proposal is part of broader anti-problem gambling measures announced by the NSW government, which includes a ban on gambling advertising on public transport, restrictions on external gambling signage outside pubs and clubs, and a reduction in cash input limits on new gaming machines from AU$5,000 to AU$500. 

In addition, the government has prohibited political donations from clubs operating electronic gaming machines and continues to conduct compliance checks in over 500 venues, ensuring responsible gaming practices are adhered to.
