A jury has awarded a Bakersfield, California woman $15 million in damages following a negligence lawsuit against MGM Resorts International and The Cosmopolitan, stemming from a 2021 injury at the Las Vegas Strip resort.
According to a report by the Las Vegas Review-Journal, the verdict, delivered last week in Clark County District Court before Judge Eric Johnson, granted Deborah Fenton compensation for a range of damages related to a fall she suffered while visiting The Cosmopolitan’s Chandelier Bar.
The jury awarded Fenton $261,751 for past medical expenses, $976,614 for future medical costs, $1.4 million for past physical and mental suffering, and a substantial $12.3 million for future pain and suffering.
Fenton filed the lawsuit on April 20, 2023, alleging she slipped and fell on September 24, 2021, due to "an unsafe and dangerous condition on the property, specifically water and glass," while she was a guest at the resort. The single-count negligence suit did not detail the full extent of her injuries.
MGM Resorts, which acquired The Cosmopolitan in May 2022 after the incident, has not yet commented on the verdict or potential appeal plans.
In a statement, the Ace Law Group, which represented Fenton, said: “This verdict reflects the seriousness of what our client endured. We’re proud to have delivered justice for Ms. Fenton and grateful to the jury for their thoughtful and decisive verdict.”
